Official Rules
GENERAL:
These are the official rules, (the “Official Rules”) for the Write A Review Sweepstakes (the “Sweepstakes”). The Sweepstakes is sponsored and administered by PCBShopper (the “Sponsor” and “Administrator”, 6 Robinson Drive, Bedford, MA 01730) whose decisions are final and legally binding, as they pertain to this Sweepstakes.
ELIGIBILITY:
NO PURCHASE NECESSARY TO ENTER OR WIN.
A purchase does not increase your chances of winning. Open to legal residents of the United States and the District of Columbia (EXCLUDING WITHOUT LIMITATION, THOSE RESIDENTS IF LOCATED IN AN OVERSEAS MILITARY INSTALLATION, PUERTO RICO, OTHER U.S. TERRITORIES OR FOREIGN TERRITORIES) who are 18 years of age or older at the time of entry and who have a valid e-mail address and Internet access during the Sweepstakes Period (as defined below). Offer void where prohibited by law, or otherwise restricted. All federal, state and local laws and regulations apply. The Sweepstakes begins at 12:01 a.m. Eastern Time (ET) on Monday, June 22, 2015 and ends at 11:59:59 p.m. ET on Wednesday, July 22, 2015 (the “Sweepstakes Period”). The Website’s clock will be the official timekeeper for this Sweepstakes. Any mass entries or entries generated by a script, macro or automated devices will be disqualified. Employees, officers, and directors of Sponsor/Administrator, Sweepstakes prize suppliers, printed circuit board manufacturers, printed circuit board CAD software developers and vendors, and each of their affiliated companies, subsidiaries, licensees, franchisees, distributors, dealers, sales representatives, their advertising and Sweepstakes agencies, and any and all other companies associated with the Sweepstakes (collectively, the “Sweepstakes Entities”), and each of their immediate family members and/or people living in the same household are not eligible to participate. All eligibility is subject to all federal, state, and local laws and regulations. All entries submitted are the property of the Sponsors.
HOW TO ENTER THE SWEEPSTAKES:
Write a review on PCBShopper.com of a PCB manufacturer or a PCB CAD software package. To write a review of a manufacturer, go to PCBShopper.com, click on a manufacturer’s name, and click the button labeled “Click here to submit your review”. To write a review of a software package, go to PCBShopper.com/cad, click on one of the links labeled “Read or write reviews”, then click the button labeled “Click here to submit your review”.
Qualifying reviews must have a valid e-mail address, a star rating, and a non-trivial review (i.e. at least a couple of sentences of useful information). You must have had experience with the manufacturer or software for which you are writing a review, i.e. you must have purchased boards from the manufacturer or used the CAD software. Your review should describe what experience you had (for example, that you’ve ordered boards from the manufacturer X times or that you have used the software for Y months, what you liked or didn’t like).
ALTERNATIVE ENTRY:
You may also enter the Sweepstakes by sending a letter with your name, mailing address, and e-mail address to PCBShopper Sweepstakes, 6 Robinson Drive, Bedford, MA 01730. Only one entry per letter. Entries must be postmarked during the Sweepstakes Period and received before the Drawing Date.
LIMIT:
Entrants may enter the sweepstakes as often as they like HOWEVER only one (1) prize per person or dwelling over the Sweepstakes Period will be awarded.
DRAWING DATE/WINNER NOTIFICATION/ODDS:
A random drawing will be conducted on or about Friday, July 24, 2015 (the “Drawing Date”) from all eligible entries received throughout the Sweepstakes Period. The odds of winning depend on the number of valid entries received divided by the number of prizes available to be won. Conduct of the Sweepstakes and the drawing are under the supervision of the Administrator. Potential prize winners will be notified by e-mail using the contact information provided at the time of entry. Sponsor shall have no liability for any potential prize winner notification that is lost, intercepted or not received by any potential prize winner for any reason. If a potential prize winner does not respond within (5) days of the first notification attempt, or if the prize or prize notification is returned as unclaimed or undeliverable to such potential prize winner, such potential prize winner will forfeit his or her prize and an alternate winner will be selected. If any potential prize winner is found to be ineligible, or if he or she has not complied with these Official Rules or declines a prize for any reason prior to award, such potential prize winner will be disqualified and an alternate prize winner will be selected from all remaining eligible entries.
PRIZES:
ONLY THE FOLLOWING PRIZES WILL BE AWARDED IN THIS SWEEPSTAKES: Two (2) $50 Gift Certificates to Digi-Key Electronics. Terms and conditions of the gift certificate apply. Retail value of all prizes in this Sweepstakes is $100.
DIGI-KEY ELECTRONICS IS NOT A SPONSOR OF THIS SWEEPSTAKES AND IS UNAFFILIATED WITH PCBSHOPPER.
PRIZE NOTICES/ NOTES:
If any selected prize winner fails to comply with these Official Rules, cannot be located or reached, has provided an incorrect e-mail or mailing address, is determined to be ineligible, fails to claim the prize, or if any prize Notification or prize is returned as undeliverable, an alternate winner will be selected without further notice. No substitution or transfer of prize or cash equivalent is permitted except by Sponsor. Any and all warranties and/or guarantees on any prize (if any) are subject to Digi-Key’s terms thereof, and winners agree to look solely to Digi-Key for any warranty and/or guarantee. Any portion of an awarded prize that remains unclaimed or expires will become void. In case of dispute as to identity of the winner, such entry will be declared made by the person whose name appears on the Sweepstakes entry registration and entered a review. ALL FEDERAL, STATE AND LOCAL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF ANY PRIZE ARE THE SOLE RESPONSIBILITY OF THE WINNER AND WILL BE BASED ON THE ACTUAL RETAIL VALUE OF THE PRIZE. Winner is solely responsible for any and all expenses relative to participation in Sweepstakes (including acceptance of prize) not specified herein. All taxes, insurance and other expenses incurred are the responsibility of the winner. No cash balance will be awarded if winner does not use the entire prize. Prize is not transferable except in the sole discretion of the Sponsor.
CONDITIONS OF PARTICIPATION:
Administrator, Sponsor, and their agencies and their respective parents, affiliates, subsidiaries, and successor companies, and their respective officers, directors, employees, representatives, and agents (hereinafter the “Released Parties”) are not responsible for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries; for failed, partial or garbled computer transmissions, or for technical failures of any kind, including but not limited to electronic malfunction or damage of any network, hardware or software or any problems or technical malfunctions of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or electronic entry to be received on account of technical problems or traffic congestion on the Internet or at any Website, or any combination thereof, including any injury or damage to entrant’s or any other person’s computer related to or resulting from participation in or downloading any materials from this Sweepstakes. Entries generated by robots or scripts are considered to be a direct violation of these Official Rules and will result in immediate disqualification of any and all associated entries. Sponsor reserves the right, in its sole discretion to cancel, terminate, or suspend this Sweepstakes should viruses, bugs, unauthorized human intervention, fraud, technical failure or other causes corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes. In such event, the prize winner(s) will be selected in a random drawing from all eligible entries received up to the time of such cancellation, termination or suspension. Sponsor also reserves the right, in its sole discretion, to cancel or terminate this Sweepstakes due to earthquake, flood, fire, storm or other natural disaster, act of God, labor controversy or threat thereof, civil disturbance or commotion, disruption of the public markets, war or armed conflict (whether or not officially declared). ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. Administrator and Sponsor are not responsible for any typographical or other printing errors in the offer or administration of the Sweepstakes, including, but not limited to, errors in the printing of posting of the offer or in these Official Rules, the selection or announcement of the winner, or the distribution of any prize.
PRIVACY:
Personally identifiable information collected by this Sweepstakes will be will be used only for administration of the Sweepstakes and the awarding of prizes.
RELEASE:
By participating, entrants release, indemnify and hold harmless the Released Parties from any and all liability for any injuries, losses, or damages of any kind caused by participation in the Sweepstakes or the acceptance, possession or use/misuse of a prize or participation in any prize-related activities. Released Parties are not responsible for the cancellation, postponement or delay of the Sweepstakes.
DISQUALIFICATION/FORCE MAJEURE:
Sponsor is not responsible for lost, late, mutilated, misdirected, illegible, incomplete, inaccurate, or stolen submissions or prize notifications. Sponsor reserves the right in its sole discretion to disqualify any individual who is found to be tampering with the entry process or the operation of the Sweepstakes, to be acting in violation of these Official Rules, or to be acting in an unsportsman-like or disruptive manner, or with the intent to disrupt or undermine the legitimate operation of the Sweepstakes, or to annoy, abuse, threaten or harass any other person, and Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. No mechanically reproduced, illegible, incomplete, forged, software-generated or other automated entries will be accepted. In the event an insufficient number of eligible entries are received and/or Sponsor is prevented from awarding prizes or continuing with the Sweepstakes as contemplated herein by any event beyond its control, including but not limited to fire, flood, natural or man-made epidemic of health of other means, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any federal state or local government law, order, or regulation, public health crisis (e.g. SARS), order of any court or jurisdiction, or other cause not reasonably within Sponsor’s control (each a “Force Majeure” event or occurrence), then Sponsor shall have the right to modify, suspend, or terminate the Sweepstakes. If the Sweepstakes is terminated before the designated end date, Sponsor will (if possible) select the winner in a random drawing from all eligible, non-suspect entries received as of the date of the event, giving rise to the termination. Inclusion in such drawing shall be each entrant’s sole and exclusive remedy under such circumstances. Only the type and quantity of prizes described in these Official Rules will be awarded. If, for any reason, more bona fide winners come forward seeking to claim prizes in excess of the number of each type of prize set forth in these Official Rules, the winners, or remaining winners, as the case may be, of the advertised number of prizes available in the prize category in question may be selected in a random drawing from among all persons making purportedly valid claims for such prize(s). The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
GOVERNING LAW/JURISDICTION:
ALL ISSUES AND QUESTIONS CONCERNING THE CONSTRUCTION, VALIDITY, INTERPRETATION AND ENFORCEABILITY OF THESE OFFICIAL RULES OR THE RIGHTS AND OBLIGATIONS OF ENTRANTS OR SPONSOR IN CONNECTION WITH THE SWEEPSTAKES SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE INTERNAL LAWS OF THE STATE OF MASSACHUSETTS WITHOUT GIVING EFFECT TO ANY CHOICE OF LAW OF CONFLICT OF LAW RULES OR PROVISIONS THAT WOULD CAUSE THE APPLICATION OF ANY OTHER STATE’S LAWS.
